Terms of Order & Fabrication

These terms apply to every order we accept and to all custom fabrication work we perform. Placing an order, paying a deposit, approving a drawing, or authorizing fabrication means these terms have been read and accepted.

1. Order and payment terms

A deposit is required to place the order, secure materials, and begin fabrication. The deposit amount, the payment schedule, and any milestone payments are stated on the customer's estimate or invoice and vary by order. The order is not released to production, materials are not purchased, and fabrication does not begin until the deposit has been received and cleared.

The remaining balance on the order is required in full to secure the installation date and must be received and cleared prior to scheduling. Installation will not be placed on the calendar until the invoice has been paid in full. For pickup orders, finished pieces are held at our facility until payment has cleared and are released only upon receipt of full payment.

Acceptable payment methods are listed on the invoice. Past-due balances accrue interest at 1.5% per month or the maximum rate permitted by applicable law, whichever is lower.

2. Order finality and customer approval

All orders for custom fabrication are final. Once an order has been placed and fabrication has begun, there are no cancellations, changes, or refunds. Customer is responsible for verifying all dimensions, layout, edge profiles, sink and cooktop placements, and material selections on the order prior to fabrication. Approval of the slab drawing constitutes authorization to fabricate the order as drawn.

3. Natural stone material

Natural stone (granite, marble, quartzite, soapstone, travertine, onyx, and similar materials) is a product of nature. Variations in veining, movement, color, mineral inclusions, pitting, and fissures are inherent characteristics of the material and are not considered defects. Samples and showroom slabs are representative only; the slab supplied on the order may vary in pattern. Customer is encouraged to view and approve actual slabs prior to fabrication.

Soft stones (marble, soapstone, travertine, onyx) are susceptible to etching, staining, scratching, and patina development. Regular sealing and gentle cleaning are required.

4. Engineered surface material

Engineered quartz, porcelain slab, and sintered surfaces (Dekton, Neolith, Lapitec, and similar) may exhibit minor batch-to-batch color variation. Quartz is heat sensitive. Direct contact with hot pots or appliances may cause permanent damage, and trivets are required. Quartz is not UV stable and is not warrantied for outdoor or sun-exposed applications. Porcelain and sintered surfaces are color consistent but brittle, and minor edge chipping during handling is possible and not considered a defect. Manufacturer warranty applies as published to the material supplied on the order.

5. Delivery and installation

Installation is not included in an order unless explicitly stated in writing on the customer's estimate or invoice. When included, scope covers delivery to the jobsite, on-site cut-to-fit adjustments, sink and cooktop fitment, edge alignment, seam epoxy, and basic cleanup.

Not included unless explicitly added: plumbing connections, electrical disconnect and reconnect, removal or disposal of existing countertops, structural cabinet modifications, and drywall or backsplash repair beyond the fabricator's installation footprint.

6. Templating and order changes

Final fabrication is based on a physical or digital template taken on-site after cabinet installation. Square footage and edge linear footage on the order may vary from the original estimate. Customer will be notified of any change to the scope or cost of the order prior to fabrication, and the order proceeds on the revised figures once approved.

7. Order lead time and delays

Any lead time, installation, or completion date given on an order is an estimate, not a guarantee. All slab material, natural and engineered alike, including granite, marble, quartzite, soapstone, travertine, onyx, quartz, porcelain, and sintered surfaces, is fabricated by hand and behaves differently once it is cut. A slab can reveal fissures, voids, soft spots, resin separation, or color and vein movement that were not visible in the whole slab. Seams and edge profiles may have to be reworked, polishing has to be carried through to a correct and consistent finish, and in some cases a piece or an entire slab has to be re-cut or replaced through the distributor. Template revisions, jobsite conditions, and cabinet, plumbing, or electrical readiness also affect the schedule.

Customer understands and accepts that the order will be installed when it has been fabricated correctly, not on a fixed calendar date, and agrees not to require the fabricator to rush or shorten any step of fabrication, finishing, or installation. A delay in delivery or installation is not a breach of this agreement. A delay does not entitle the customer to a refund, credit, discount, or cancellation of the order, and does not release the customer from the payment schedule. The fabricator will keep the customer informed of any change to the projected schedule.

8. Right to cure

If the customer believes any part of the material, fabrication, or installation on an order is not correct, the customer must notify the fabricator in writing, describing the issue, before engaging another party, withholding payment, or initiating a chargeback or claim. The fabricator is entitled to a reasonable opportunity to inspect the work and to cure, which may include repair, refinishing, re-fabrication, or replacement of the affected piece.

Cure is the customer's sole and exclusive remedy. Refunds are not provided. Work performed by anyone other than the fabricator, and any chargeback initiated before the fabricator has been given the opportunity to inspect and cure, voids the workmanship warranty and ends any further obligation to cure.

9. Workmanship warranty

The fabricator warrants the workmanship on each order for one (1) year from installation date against defects in seam quality, edge fabrication, and fitment. Material warranty, if any, is governed by the manufacturer's published terms. Damage from impact, improper use, harsh chemicals, or lack of recommended maintenance is not covered. Lien rights are reserved on all materials and work product until the invoice is paid in full.

10. Unpaid balances and abandoned orders

All material on an order, whether in process or finished, remains the property of the fabricator until the invoice is paid in full. If a balance remains unpaid thirty (30) days past its due date, the fabricator will notify the customer in writing that the account is past due. The customer then has an additional thirty (30) days from the date of that notice to pay the balance in full or to make written payment arrangements with the fabricator.

If the balance remains unpaid sixty (60) days past its original due date, the order is considered abandoned. Material from an abandoned order may be cut down, resold, recycled, or otherwise disposed of at the fabricator's discretion, and all deposits and payments already made are forfeited and are not refundable. Storage of finished pieces beyond sixty (60) days from the date the customer is notified the job is ready is at the fabricator's discretion and may be subject to a storage fee.

A customer who anticipates a payment difficulty is encouraged to contact the fabricator before the balance goes past due so arrangements can be made.

11. Acceptance of these terms

These terms are incorporated by reference into every estimate, quote, order confirmation, invoice, and work authorization we issue. Placing an order, paying a deposit, approving a drawing, or authorizing fabrication constitutes acceptance of these terms in full, whether or not a separate signed copy exists. Where a signed written agreement states something different, that agreement controls for that order only. These terms may be updated at any time, and the version posted on this page at the time the order is placed is the version that applies to that order.
